The position taken up by the Government with regard to the particular case of goods seized at sea and brought in by His Majesty's Ships is expressed in the following extract from a despatch from His Excellency the Governor to Vice-Admiral Grant, Commanding-in-Chief, China Station:-
*I have the honour to acknowledge your letter of the "22nd. July relating to the carriage of enemy goods.
"Prize Court proceedings will be taken in all proper "cases against any alleged enemy cargo seized at sea and "brought into Hongkong, including of course cargo which is the "property of enemy subjects resident or carrying on business "in China or Siam, and the question will be considered of "prosecuting any persons amenable to the jurisdiction of the "Courts of this Colony.
"In the case of cargo which is the property of persons or "the Statutory List, or of persons on the China or Siam Black *List who are not enemy subjects, it would appear that the "only action possible against the goods will be to prevent "their being forwarded to their destination, as such persona "ere not enemies for Prize Court purposes".
Admiral Grant had informed the Governor that instructions had been given to His Majesty's Ships operating in these waters to bring into port any British ships found carrying either enemy goods or goods belonging to firms on the Statutory List or China or Siam Black Lists.

It was supposed, however, that His Majesty's Government intended a distinction to be drawn between the ense of goods seized at sen outside the jurisdiction of the Colony, and the case of goods consigned for transhipment at Hongkong and so voluntarily brought within the jurisdiction of the Colony. It was believed that the intention was that goods of the latter class should be liable to forfeiture, not on the ground of enemy omer- -ship,origin or destination, but on the ground of the illegality of handling such goods within the jurisdiction if of enemy omer- -ship, origin or destination.
